This website is owned and operated by Ozzari Australia, the publisher of the online store at https://ozzariaustralia.com (hereinafter “the Site”). The Site is hosted by Shopify Inc., 150 Elgin Street, 8th Floor, Ottawa, Ontario, K2P 1L4, Canada.

ARTICLE 1 — Definitions

  • “T&Cs”: These Terms and Conditions that govern the use of the Site.

  • “User Account”: The personal customer account created on the Site.

  • “Credentials”: The username and password chosen by the User.

  • “Registration”: The process of creating a User Account.

  • “Service”: The online purchasing services provided by Ozzari Australia.

  • “Site”: Refers to https://ozzariaustralia.com.

  • “User”: Any natural or legal person over the age of 18 who registers and uses the Service.

  • “Visitor”: Any person who browses the Site without creating an account.

ARTICLE 2 — Acceptance of the Terms

By accessing or using the Site, the User acknowledges having read, understood, and accepted these T&Cs without reservation. Tick-box acceptance during checkout or account creation constitutes contractual consent.

Ozzari Australia may update these T&Cs at any time. Continued use of the Site implies acceptance of the updated version.

ARTICLE 3 — Access to the Site

The Site is accessible to any User with internet access. All connection costs (hardware, software, internet) are at the User’s expense.

ARTICLE 4 — Registration

Creating a User Account is free. Only individuals 18 or older may register. The User agrees to provide accurate personal information. Credentials are personal and must not be shared.

Ozzari Australia reserves the right to refuse or delete any account in the event of fraud, false information, abuse, or violation of these T&Cs.

ARTICLE 5 — Suspension or Deletion of Account

A User may request account deletion at any time via support@ozzariaustralia.com, provided no orders are pending. Ozzari Australia may suspend or delete User Accounts in cases of fraud, abuse, defamatory behaviour, or violation of the T&Cs.

ARTICLE 6 — User Obligations

The User agrees NOT to:

  • Violate Australian law or third-party rights.

  • Upload illegal, defamatory, abusive, fraudulent, or harmful content.

  • Attempt to hack, reverse engineer, disrupt, or overload the Site.

  • Copy, reproduce, or extract Site content without written permission.

The User is responsible for securing their own equipment and internet connection.

ARTICLE 7 — Intellectual Property

All content on the Site (texts, images, logos, graphics, videos, etc.) is protected by Australian intellectual property law. Any reproduction without written permission is prohibited.

ARTICLE 8 — Warranty & Liability Limits

The Site is provided “as is” and “as available.” Ozzari Australia shall not be held liable for:

  • Service interruptions

  • Internet/network failures

  • Data loss, delays, viruses, or hacking attempts

  • Incompatibility with User equipment

  • Third-party link content

Use of the Site is at the User’s own risk.

ARTICLE 9 — Force Majeure

Ozzari Australia shall not be held liable for failure to perform due to events outside its control (natural disasters, strikes, outages, regulations, etc.).

ARTICLE 10 — Cookies

Cookies may be stored for functional, analytical, or advertising purposes. Users can disable cookies via their browser settings. More details appear in our Cookie Policy.

ARTICLE 11 — SMS & Email Marketing Consent

By subscribing to SMS or email marketing, the User agrees to receive recurring messages. The User may unsubscribe at any time by replying STOP (SMS) or clicking the unsubscribe link (email). Standard carrier rates may apply.

ARTICLE 12 — Proof Agreement

Electronic acceptance (checkbox, timestamp, order confirmation, or email record) has the same legal value as a handwritten signature under Australian law.

ARTICLE 13 — Partial Invalidity

If any clause is deemed invalid, the remainder of the T&Cs remains fully effective.

ARTICLE 14 — Governing Law & Disputes

These T&Cs are governed by Australian law. In case of dispute, parties shall first attempt an amicable resolution. Failing that, Australian courts have exclusive jurisdiction.
